Abstract

The rites of the traveler's worship, especially prayers and fasting, are related to the homeland, which is why in jurisprudence the determination of the homeland and its rules are more important than this. Homeland is the place where a person lives. This living space is divided into real homeland, electoral homeland and sharia homeland. There is no significant difference between the jurists in the jurisprudential definition and the basic rules of the original homeland and the chosen homeland. However, there is a difference of opinion among the jurists on the affirmation of the Shariah homeland. The famous late jurists are credited with being convinced of the Shari'ah homeland, while the early jurists are not convinced of the concept of the Shari'ah homeland. According to the jurists, the consensus among the above-mentioned types of Watan is that a person will perform the prayers in full and will also fast in the month of Ramadan. Deportation and emigration If the intention is intentional, intentional and practical, then the rule of thw homeland will be taken away from this person, but if there is only intention and no practical form, then the rule of the homeland will remain. Will Therefore, in view of this, the arguments on the types of watan and the dissenting opinions of the jurists have been examined in this article and the view of the contemporary jurists on the affirmation of the Shariah homeland has been proved.
